 “Privacy Policy” means this Privacy Policy including all modifications, amendments, restatements, replacements and all Notice provisions, intended to comply with the CCPA. This Privacy Policy is a part of the “Additional Terms”, which defined in the Site Terms.

“Site” and “Use of the Site” are defined in the Site Terms.

“Third-Party Service Provider” or “TPSP” means those vendors, business partners, service providers, web hosting services, payment processors, security providers, data and web analytics and marketing servicers, database management and web maintenance servicers, contractors, affiliates, and internet service providers that we may work with, hire or partner with to support the functionality of this Site.

“We”, “Us” “Our” or “I”, whether or not capitalized, are defined in the Site Terms.

“You” or “Your”, whether or not capitalized, are defined in the Site Terms.

We collect your Personal Information when you visit or Use the Site, when you communicate or contact us, or create an account on the Site. ·         Personal Information from our TPSPs,

·         Personal Information from internet service providers and data analytics providers,

·         Personal Information on social media platforms when you interact with us on those platforms or access our social media content,

·         Non personally identifiable information or aggregated consumer information,

·          Personal Information from publicly accessible sources and government entities (i.e.; property records or court records),

·         Personal Information categories listed in the California Customer Records Act (Cal. Civ. Code § 1798.80(e)).

WHAT WE DO NOT COLLECT

We do not knowingly or intentionally collect:

·         information from children under 13. If you are under the age of 18 you may not Use the Site, create, own or operate an account on or in connection with the Site. We will delete any accounts known or suspected to be created or operated by anyone under the age of 18,

·         process or store your payment information, but a third-party payment processor may, in accordance with your agreement with them,

·          sensitive personal information, such as protected classification data or personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data regarding sexual orientation,

·         information governed by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the California Confidentiality of Medical Information Act (“CMIA”), the Fair Credit Reporting Act (“FCRA”), the Gramm-Leach-Bliley Act (“GLBA”), California Financial Information Privacy Act (“FIPA”), or the Driver’s Privacy Protection Act of 1994 (“DPPA”),

·         Personal Information collected by third-parties (as defined under the CCPA) including parties that sell, retain, use or disclose Personal Information for purposes beyond the scope of our business relationship with any such entities.

HOW YOUR PERSONAL INFORMATION IS COLLECTED

 

You do not have to give us any Personal Information in order to Use most features of the Site, and in most instances, you voluntarily provide us with your Personal Information.

We collect most Personal Information directly provided by you when you visit the Site, create an account on the Site or if you send an Electronic Communication to us. We may collect Personal Information from our affiliates, which you contact in connection with this Site.

Your information, including Personal Information, may be transferred to and maintained on servers located outside of your state, province, country or other governmental jurisdiction where data protection laws differ from those in your jurisdiction. We will take commercially reasonable steps to treat your data in accordance with this Privacy Policy.

OTHER SOURCES THAT MAY COLLECT YOUR INFORMATION

We utilize TPSPs to facilitate operation of the Site. These TPSPs may access your Personal Information in the operation and functionality of the Site. We may receive Personal Information from other sources such as our TPSPs or social media platforms.

Third-party web platforms and payment servicers (which you choose) may collect your payment information, in accordance with their privacy policies and any agreement you have with them.

Google Analytics is a web analytics service that tracks and reports website traffic and uses the data collected to track and monitor the use of the Site. This data is shared with other Google services. You may be able to opt-out of having your activity on our Site available to Google Analytics by installing the Google Analytics opt-out add-on to your browser.

WE DO NOT SELL YOUR PERSONAL INFORMATION

 

We do not sell your Personal Information. We will not sell your Personal Information without first providing you with notice and an opportunity to opt-out of such sale as required by law. 

When you buy any Products, You may transfer your Personal Information by using third party payment servicers with whom you contract. Such transaction is governed in accordance with such third party servicers’ privacy policy, but usually you have the right to opt out.

·         if we believe in good faith that disclosure is necessary to protect our property, IP or rights, to protect the interests of our affiliates, users or customers, those of third parties or the public at large;

·         if the Site is involved in a potential or actual change in ownership, control, merger, acquisition or some other transfer of ownership of the Site;

·         We may share certain aggregated, non-personally identifying information with our TPSPs about how our users and customers use the Site.

OUR USE OF COOKIES AND TRACKING

The Site uses cookies to provide, secure and improve the Site, and to keep track of referral information, to identify areas of the Site you have visited, or to help personalize the content you see on the Site. We and our TPSPs may also use third party tracking tools to improve performance and features of the Site which we understand to be designed to collect only non-personally identifying information. Such tools are created, operated and managed by parties outside of our control, and we are not responsible for what information is actually captured by such third parties or how such third parties use and protect such information.

 “Do Not Track” (DNT) is a privacy preference you can set in your browser if you do not want online services to collect and share certain kinds of information about your online activity from third party tracking services. If you would like to set your browser to signal that you would not like to be tracked, please check your browser’s documentation for how to enable that signal.

DATA RETENTION

Generally, we retain Personal Information for as long as necessary to operate the Site, while your account is active, to deliver purchased Products, within the context of an ongoing business relationship, to comply with applicable law, fulfill our legal obligations, enforce the Site Terms, our agreements and policies, security of the Site, dispute resolution, protection of the exercise of free speech, in relation to the performance of a contract, to comply with the Attorney’s ethical obligations or as necessary for any legal proceeding or law enforcement requirement.

If you would like to cancel your account or delete your Personal Information, you may delete your account subject to the deletion rights provisions below and in the Terms.

HOW WE COMMUNICATE WITH YOU

We communicate with you mainly by electronic mail or telephone. You can control the way we contact you by emailing us at support@furtonlegal.com and telling us whether you prefer communication by electronic mail or telephone.

We may occasionally send notification emails about changes to our Terms and Policies operations or new Services. We may also send communications if you have requested or registered to receive promotional emails, based on your choices and in accordance with applicable laws and regulations. You understand that you can remove yourself from promotional communications by clicking the “Unsubscribe” link in the footer of the actual communication. You cannot opt out of essential communications regarding your account, such as billing.

Please see the Site Terms for more rights and limitations on communications, including “Inquiries”. The Attorney has no obligation to respond to any Inquiry or request for legal services.

VERIFIABLE CONSUMER REQUEST FOR INFORMATION

Subject to these terms, and to the extent we are required to do so by applicable law, we will make commercially reasonable attempts to respond to your “Verifiable Consumer Request”, requesting that we disclose to you the following information about you collected and used in the past 12 months:

·         Categories of Personal Information we collected about you;

·         The business or commercial purpose for collecting Personal Information;

·         Categories of third parties with whom we share that Personal Information; or

·         The specific pieces of Personal Information we collected about you (i.e.; data portability).

Only you, or a confirmed authorized agent registered with the California Secretary of State authorized to act on your behalf, may make a Verifiable Consumer Request related to your Personal Information.

You may also make a Verifiable Consumer Request on behalf of your minor child, provided you deliver to us evidence which verifies your right to that information. We reserve the right to require and receive evidence, sufficient in our sole discretion, to verify your relationship to your child before we honor such request.

You may only make a Verifiable Consumer Request twice within a 12-month period. The request must:

·         Provide proof and information, sufficient in our sole discretion, to allow us to verify you are the person about whom we collected Personal Information or a legally authorized representative.

·         Describe your request with detail sufficient, in our sole discretion, to allow us to properly understand, evaluate, and respond to it. We may charge you a fee.

We reserve the right not to make data access or any portability disclosures (regardless if are required by law) if we cannot verify the person making the request is the person about whom data was collected about or their authorized agent. We reserve the right to decline to provide you requested information for any reason, including, if the request is, in our opinion, laborious to address, repetitive, excessive or frivolous. We reserve the right to charge a reasonable fee for the production of any requested information, at an hourly rate not to exceed $50/hr.

RESOLVING PRIVACY CONCERNS

If you have concerns about the manner in which we handle your Personal Information, please let us know immediately. You may contact us by emailing us at support@furtonlegal.com with the subject line “Privacy Concerns.” We will use commercially reasonable efforts to respond within 45 days of receipt of all information needed to investigate the concern. If we require more time, we will inform you of our need for more time.  If you have an account with us, we will deliver our response to the registered email associated with your account.  If you do not have an account with us, we will deliver our response to the email or address you have provided in your privacy concern.

We cannot respond to your request or provide you with information about your Personal Information if we cannot, in our sole discretion, verify your identity, confirm you have the appropriate authority to make your request, or confirm the Personal Information relates to you. 

We do not typically charge a fee to process or respond to requests unless such request is, in our opinion, laborious to address, excessive, repetitive, or frivolous.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before commencing to respond to your request.

DELETION REQUEST RIGHTS; EXCEPTIONS

 

You may contact us to request that we delete any of your Personal Information we collected and retained, subject to certain exceptions. Once we receive and confirm your Verifiable Consumer Request, we will delete (and request our TPSPs delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our TSPS:

·         to complete any transaction or provide a Product that you purchased;

·         to take actions reasonably anticipated within the context of an ongoing business relationship;

·         as needed for the performance of our legal or contractual obligations;

·         to investigate or detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

·         to debug products to identify and repair errors that impair existing intended functionality;

·         to address ongoing disputes complaints or concerns;

·         for ongoing security and Site functionality concerns;

·         as needed for compliance with applicable laws, including the protection of the exercise of free speech;

·         to fulfill a legal obligation;

·         if related to law enforcement proceedings;

·         if related to the Attorney’s ethical obligations (including if you hire Services);

·         as needed to protect or preserve the rights of others;

·         as necessary for our internal business use in a manner consistent with the functionality of the Site; or

·         to comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

If we are required to delete your account, we will use commercially reasonable efforts to do within 90 days of your request.

EMAIL AND TELEPHONE POLICY

We comply with state and federal laws regarding SPAM. You may opt out of email correspondence with us as provided in this Privacy Policy.

We comply with state and federal laws regarding phone calls and text messages. You may opt out of telephone calls and text messages by emailing us at support@furtonlegal.com.

NON-DISCRIMINIATION

Although the CCPA does not apply to us or this Site, we will not discriminate against you for exercising any of the rights provided under the CCPA. We will not deny you goods, charge different prices, or provide any different quality of goods on the basis of the exercise of rights provided under the CCPA.

CHILDREN’S PRIVACY

Access to and Use of this Site is prohibited for people under the age of 13.  We are unable to verify the age of any visitor or user, and have no responsibility or liability for verifying a user’s age or enforcing this prohibition in anyway.

We do not knowingly gather personal information (as defined by the U.S. Children’s Privacy Protection Act of 1998, or “COPA”) in a manner not permitted by COPA. If you are a parent or guardian and you believe we have collected information from your child in a manner not permitted by law, email us at support@furtonlegal.com with “COPA Concern” in the subject line.

If you are a California resident under 18 years old and have created an account on the Site, you can ask us to remove any content or information you have provided. To make a request, email us at support@furtonlegal.com with “California Under 18 Content Removal Request” in the subject line, and tell us what you want removed. We will make commercially reasonable efforts to remove content, although we cannot ensure the complete or comprehensive removal of the content and may retain the content as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

LEGAL SERVICES

If you choose to hire the Attorney for legal work there are circumstances in which information you have submitted to us on this Site may be used in connection with such Services. For example, if you communicate with the Attorney regarding Services by linking through this Site, your Personal Information submitted to us may be reviewed in order to determine if the Attorney can provide you Services as legally required for conflict checks, to respond to your Inquiry, or to carry out your requested services.

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

·         None. This website was created before and made operational on May 31, 2021.

In the preceding twelve (12) months, we have not sold any Personal Information.

CHANGES TO OUR PRIVACY POLICY         

We reserve the right to amend this Privacy Policy at our discretion and at any time.
